These are the terms and conditions on which we supply products to you as a domestic customer.

Please read these terms and conditions carefully before you submit your order to us. These terms tell you who we are, how we will provide the products to you, how you and we may change or end the agreement, what to do if there is a problem and other information.

We may update these Terms and Conditions from time to time by posting the updated Terms and conditions on our Website in place of these.  The changes will apply to the use of the WFS Website after we have given notice.  If you do not wish to accept the new Terms and Conditions, you should not continue to order from WFS or use the WFS Website.  If you continue to use the WFS Website after the date on which the change comes into effect, your use of the WFS Website indicates your agreement to be bound by the new Terms and Conditions.  Our normal terms and conditions can also be found on this website under the heading of  “terms and conditions”.

Information about us and how to contact us

We are Alistair and Christine Sellick trading as Weston Fruit Sales, our business address is Unit 1, Kiln Park, Searle Crescent, Weston-super-Mare, North Somerset, BS23 3XP

If we have to contact you we will do so by telephone or by writing to you at the email address you provided to us in your order.

Orders and Delivery

Orders may be placed on the website – www.westonfruitsales.co.uk or by telephone 01934 621525 or emailing us by 8pm at westonfruitsalesorders@gmail.com

Orders placed on the website or by email, telephone, or in person will be acknowledged by WFS and confirmed within 24 hours of receipt of your order (excluding weekends and public holidays).  The agreement between us will only be formed when we send you the confirmation of the order, rather than receipt of the email or, in the case of telephone orders, when we confirm your order at the end of the call.

Where items are sold by weight, WFS will endeavour to deliver them as near as possible to weight specified and they may be over or underweight. You will only be charged for the weight actually delivered.

The price for the items ordered shall be in accordance with the price per kilo displayed online or quoted at the time of the order unless agreed otherwise in writing and we will pass on any changes in the rate of VAT.

In the event that your delivery is stolen from your doorstep or damaged while there, we do not accept liability.

WFS does not accept responsibility for any further temperature control and product integrity once we have delivered to your door. We do not currently use chill packaging. If you have any questions about your delivery, please don’t hesitate to contact our customer service team.

Prices on items may vary due to market fluctuations.  Products can differ daily.

Once we have confirmed an order pursuant to above, there is no right to cancel as the items sold are of a perishable nature.

If we are unable to supply you with a product, for example because that product is not in stock or no longer available or because of an error in the price on our site, we will not be able to process that part of your order.

To ensure delivery of any product on a particular day, you should place your order at least 24 hours before you require the product or the time specified for that product. A ‘working day’ is any day other than a Saturday, Sunday or public holiday.

Please check the delivery days to your area.  If you place an order but have not specified a day, your order will be delivered on the day convenient to ourselves.

Deliveries may be subject to charge depending upon order value. Minimum orders are £20.

Delivery of an order shall be completed when we deliver the products to the address you provide to us and/or leave the products in the location you specified if you are out. The items will be your responsibility from that time.

You own the products when we receive payment in full.

Reliance

Whilst we take steps to ensure the accuracy of the information accessed via this site, we cannot guarantee or give any warranty as to the accuracy, timeliness or completeness of any information or material appearing on it.  We have no responsibility for content provided by third parties and are merely providing access to such content to you.  We have no obligation to verify the content of such information nor to edit any such information provided by third parties.  We do not endorse, support, represent or guarantee the truthfulness, accuracy, or reliability of any third party details and you acknowledge that any reliance on such information will be at your own risk.

You may be asked to input your personal information.  Please see our Privacy Policy for further details.  Where you do consent to our holding and use of your personal information, it is intended that such consent will benefit any purchaser of our business.

Cookies Policy

Websites or pages to which this site is linked (other than other websites operated by us) are for information only and have not been reviewed by us.  We have no responsibility for the content of such websites or pages and accept no liability for any losses whatsoever that may be incurred as a result of any linking to the same.

Governing Law and Jurisdiction

These conditions are governed by the laws of England.

Ending the agreement

You must clear any debit balance upon your account within 5 working days of ending the agreement.

Credit balances are not refundable and you must take any credit balance by ordering further items to the amount of the credit.

WFS may end the agreement by giving you notice in writing if you do not make payment when due, if any payment by debit or credit card is refused by the card provider.

Inactive Accounts

If there are no orders placed and no payments made on your account for a continuous period of 3 months your account will be closed.

Dormant Account

If there are no orders on your account for 12 months WFS will retain any credit balance on your account which is more than 1 year old.

Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of your obligations under the agreement that is caused by an act or event beyond our reasonable control.

If an event outside our control takes place that affects the performance of our obligations under the agreement:

(a) we will contact you as soon as reasonably possible to notify you; and
(b) our obligations will be suspended and the time for performance of our obligations will be extended for the duration of the event outside our control affects our delivery of items to you, we will arrange a new delivery date with you after the event outside our control is over.

Liability

If we fail to comply with these terms and conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms and conditions or our negligence. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you or us at the time we entered into these terms and conditions.

As a domestic customer, we only supply items online for domestic and private use. You agree not to use the items for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity. We do not in any way exclude or limit our liability for:

(a) death or personal injury caused by our negligence;
(b) fraud or fraudulent misrepresentation;
(c) any other matter for which it is unlawful to exclude or limit liability.

Allergens

WFS handles celery, celeriac, soya, sulphites, milk, nuts and other allergens. There is a risk of cross-contamination of these when you buy any of our products. Please bear this in mind.

Images

All images are a representation of the product and may not be exactly the same as you receive.

General

When received, you must inspect them and notify us promptly in writing, by email or by telephone with any dissatisfaction with your order.  Where possible, a photograph is required.  We will arrange for the collection and delivery of replacement items or refund the price of those items but you must notify us within 24 hours of the original delivery.

You are responsible for providing us with your up to date contact details including your name, email address, invoice address and telephone number.

As a domestic customer, you have consumer legal rights in relation to goods that are faulty or not as described.  Nothing in these terms affects these legal rights.

The agreement is subject to the law of England and Wales.
